งานวิจัยเรื่อง “การปรับปรุงแนวทางพิจารณาคดีค้ามนุษย์ อันเนื่องมาจากปัญหาการตีความ
ในดุลพินิจของศาลเปรียบเทียบกฎหมายต่างประเทศ” มีวัตถุประสงค์ในการวิเคราะห์ปัญหา
เกี่ยวกับการใช้การตีความในกฎหมายว่าด้วยวิธิพิจารณาคดีค้ามนุษย์ซึ่งเริ่มจากการวิเคราะห์
บทบัญญัติเกี่ยวกับความหมายของคดีค้ามนุษย์ดุลพินิจการกำหนดค่าสินไหมทดแทน หลักการใหม่เกี่ยวกับการให้ข้อมูลที่สำคัญ และเป็นประโยชน์ในการปราบปรามการกระทำความผิดฐานค้ามนุษย์ ตลอดจนแนวทางการนำระบบไต่สวนมาปรับใช้ในการแก้ไขคำฟ้องและพิจารณาคดีลับหลังจำเลย
ผลการวิจัยพบว่า 1) การตีความถึงความหมายของคดีค้ามนุษย์ไม่ครอบคลุมถึงผู้กระทำความผิดที่มีการซื้อบริการทางเพศ 2) การกำหนดค่าสินไหมทดแทนให้แก่เหยื่อคดีค้ามนุษย์ยังเป็นหลักเกณฑ์ใหม่ที่ให้ศาลทำหน้าที่กำหนดในเชิงรุกแต่ยังไม่มีแนวทางปฏิบัติที่แน่นอน 3) การกำหนดดุลพินิจของศาลในการกำหนดค่าสินไหมทดแทนให้แก่เหยื่อ ยังไม่มีแนวทางที่ชัดเจนแน่นอน 4)การตรวจฟ้องและสืบพยานลับหลังจำเลยยังไม่เป็นไปตามแนวทางในระบบไต่สวน ผู้เขียนได้เสนอแนะแนวทางในการปรับปรุงไม่ว่าในแง่ความชัดเจนของตัวบทกฎหมายซึ่งให้รวมถึงผู้กระทำผิดที่มีการซื้อบริการทางเพศและแนวทางในการพิจารณาให้มีความชัดเจนยิ่งขึ้น เพื่อให้เป็นไปตามเจตนารมณ์ของการประกาศใช้กฎหมายเพื่อให้การป้องกันและปราบปรามการค้ามนุษย์เป็นไปอย่างมีประสิทธิภาพ"
The objective of this study, “Improving the Judicial Approach in Human Trafficking
CriminalProcedure Law through revised Interpretation at the Discretion of the Court,
a Comparative Study between Thailand and Foreign Countries” is to analyze the issues concerning
the application and interpretation of human trafficking criminal procedure law. To conduct the
study, extensive analysis was completedin both Thai and foreign textbooks, laws and papers, in
specifically: the provision regarding the definition of human trafficking, discretion in the
assessment of compensation, the new principle ofgiving essential and useful information in order
to suppress the commission of the human trafficking offence as well as guide lines to apply the
inquisitorial system to the amendment of plaint and the trial in absentia. The results show that 1)
the interpretation of the definition of the human trafficking case does not cover a person who
purchase sexual services, 2) The assessment of compensation to the victim of human trafficking is
considered a new regulation which pushes responsibility to the court to take initiative, but there is
yet to be a precedent standard references or solid practice for the regulation, 3) The exercise of
judicial discretion to assess compensation to the victim does not have a standard practice nor
guidance and 4) Lawsuit verification and taking evidence in absentia does not conform to the
standard practice of the inquisitorial system. In addition to the resultsof the study, the
recommendation is to improve and clarify the practice of such issues asprovided in this study,
including the mentioned legal provision which should bind the sex buyer and the explicit principle of trial of the said case in order to achieve the purpose of law enforcement which is to effectively
prevent and suppresshuman trafficking crimes.
