การประกาศใชรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2560 แสดงให้เห็นถึง
พัฒนาการเชิงอำนาจหน้าที่ของศาลรัฐธรรมนูญ โดยเฉพาะการให้บุคคลซึ่งถูกละเมิดสิทธิหรือ
เสรีภาพที่รัฐธรรมนูญรับรองสามารถยื่นคำร้องว่าการกระทำนั้น ขัดหรือแย้งต่อรัฐธรรมนูญหรือไม่
ซึ่งกระบวนการยุติธรรมทางเลือกอาจนำมาปรับใช้ในกรณีดังกล่าวได้หากเกิดปัญหาในอนาคต
เนื่องจากกระบวนการยุติธรรมทางเลือกน้ั้น เป็นเครื่องมือในการช่วยเหลือคู่กรณีใหสามารถตกลงยุติ
ข้อพิพาทโดยคงความสัมพันธ์ไว้ ประหยัด และมีความรวดเร็ว
Promulgation of the Constitution of the Kingdom of Thailand reflects the development of the
Constitutional Court especially a person whose rights or liberties guaranteed by the Constitution
are violated, has the right to submit a petition to the Constitutional Court for a decision on whether
such act is contrary to or inconsistent with the Constitution. The Alternative Dispute Resolution
(ADR) may be applied in case of problems arise in the future since ADR is a mechanism to
support parties to end conflicts and maintain relationship, economize, and save time.
